These Terms of Service (“Terms”) govern your access to and use of Trustless Payments (the “Service”), including our website, applications, APIs, and messaging-bot interfaces. By using the Service, you agree to these Terms.

Important: Trustless Payments provides software tooling and automated routing only. We are not a bank, broker, escrow agent, custodian, or fiduciary. Blockchain transactions can be irreversible. Use at your own risk.

1. Eligibility

You must be legally capable of forming a binding agreement to use the Service. If you use the Service on behalf of an organization or entity, you represent and warrant that you have authority to bind that entity to these Terms.

If your jurisdiction restricts or prohibits blockchain, digital asset, or token-related services, do not use the Service.

2. The Service

Trustless Payments provides software tools designed to help users coordinate conditional, automated payment flows on public blockchains. The Service may include generating deposit instructions, monitoring on-ledger events, tracking conditions (such as deadlines or data inputs), and triggering automated actions based on predefined logic.

We may update, modify, suspend, or discontinue any part of the Service at any time without notice.

3. Non-Custodial Nature

The Service is designed to be non-custodial. We do not hold user funds or control your private keys or seed phrases. Automated actions may fail or be delayed due to factors outside our control, including network congestion, node outages, ledger behavior, software bugs, or third-party failures.

You are solely responsible for verifying wallet addresses, destination tags or memos, amounts sent, conditions configured, and transaction confirmations. Blockchain transactions may be irreversible.

4. Fees

The Service may charge fees for certain actions, such as creating or managing automated payment flows. Applicable fees will be disclosed before you confirm an action. Fees are non-refundable except where required by law.

Network or protocol fees are separate and are paid directly to the blockchain network, not to us.

The Service may rely on third-party infrastructure (blockchain nodes, explorers, market data APIs, messaging platforms). We do not control those providers and are not responsible for their downtime, accuracy, or changes.

Market data can be delayed, incorrect, or manipulated. Do not treat it as investment advice or a guarantee.

8. Availability, Bugs, and Beta Features

The Service may experience interruptions, delays, or errors. Some features may be labeled beta/experimental and may behave unexpectedly. You agree that you are using the Service “as is” and at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not provide legal, tax, or investment advice. Nothing in the Service constitutes an offer to sell or a solicitation to buy any security or financial instrument.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSTLESS PAYMENTS AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT OF FEES YOU PAID TO US (IF ANY) IN THE 30 DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify and hold harmless Trustless Payments and its operators from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.

12. Termination

We may suspend or terminate access to the Service at any time if we believe you have violated these Terms, pose a security risk, or create legal exposure. You may stop using the Service at any time.

13. Changes to Terms

We may update these Terms from time to time. The “Last Updated” date will reflect the latest version. Your continued use after changes become effective means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction of Cheyenne, Wyoming, United States, without regard to conflict of law rules. Where required, disputes will be resolved in the competent courts of that jurisdiction.
